Document Validity

A will generated by MyEasyWill must be properly signed and witnessed in accordance with the laws of your State or Territory to be legally valid. A document that is not properly executed may be invalid and could result in your estate being distributed under the laws of intestacy, which may not reflect your wishes.

Execution requirements vary by State and Territory. It is your responsibility to ensure your will is signed and witnessed correctly. We strongly recommend having your completed will reviewed by a qualified Australian solicitor before signing.

When You Must Seek Legal Advice

You should seek independent legal advice from a qualified solicitor before using this service if any of the following apply to you:

Superannuation

Superannuation does not automatically form part of your estate and is generally not controlled by your will. You must contact your superannuation fund directly to nominate or update your beneficiaries. MyEasyWill accepts no responsibility for the distribution of superannuation benefits.

Family Provision Claims

Under Australian law, certain eligible persons (including spouses, children, and dependants) may be entitled to make a family provision claim against your estate even if they are not included in your will. MyEasyWill does not provide advice on minimising or managing such claims. If this is a concern, please consult a qualified solicitor.

Accuracy of Information

MyEasyWill generates documents based solely on the information you provide. We do not verify, check or validate the information you enter. It is your sole responsibility to ensure all information is accurate, complete and up to date. MyEasyWill accepts no responsibility for errors, omissions or inaccuracies in the information you provide.

Limitation of Liability

To the maximum extent permitted by Australian law, MyEasyWill, its directors, employees and agents will not be liable for any loss, damage, claim or expense of any kind arising from your use of this service, including but not limited to any direct, indirect, incidental, consequential or special damages, even if we have been advised of the possibility of such damages.

Terms of Service

These Terms of Service ("Terms") govern your use of the MyEasyWill website and document preparation service ("Service") operated by MyEasyWill Pty Ltd ABN XX XXX XXX XXX ("we", "us", "our"). By using our Service, you agree to these Terms.

MyEasyWill provides an online document preparation service that generates a personalised Last Will and Testament based on information you provide. We are a document preparation service only and do not provide legal, financial or other professional advice.

The fee for this Service is $10.00 AUD (inclusive of GST). Payment is processed securely through Stripe. Once payment is made and your document has been generated and delivered, we do not offer refunds. If you experience a technical issue that prevents delivery of your document, please contact us at support@myeasywill.com.au and we will resolve the issue promptly.

4. Document Updates

We offer free document updates within 60 days of your original purchase. After 60 days, a new payment of $10.00 AUD is required to generate an updated will. It is your responsibility to review and update your will when your circumstances change, including marriage, divorce, birth of children, significant changes in assets, or the death of a beneficiary or executor.

The document generated for you is yours to use as your personal will. All other content on this website including text, design, software and trademarks remains the intellectual property of MyEasyWill Pty Ltd and may not be reproduced without permission.

To the maximum extent permitted by Australian Consumer Law, our total liability to you for any claim arising from your use of this Service is limited to the amount you paid for the Service ($10.00 AUD). We are not liable for any indirect, incidental, special or consequential loss or damage.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law that cannot be excluded, restricted or modified.

9. Governing Law

These Terms are governed by the laws of New South Wales, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of New South Wales.

10. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
